Portrait Photography Terms & Conditions
Effective Date: 9/22/2026
These Terms & Conditions apply to portrait photography services provided by Finksey Studios (“Studio,” “we,” “us,” or “our”). By booking a session, the client (“Client,” “you,” or “your”) agrees to these terms.
1. Booking & Retainer
A photography session is considered booked once the Studio has received the required retainer and/or payment.
The retainer is applied toward the total session fee and is [refundable under the cancellation terms below], except where otherwise required by law.
Your session date and time are not guaranteed until the required payment has been received.
2. Payments
The remaining balance is due [in person/directly before the session].
Images, galleries, prints, products, or other deliverables will not be provided until all outstanding balances have been paid in full.
3. Rescheduling & Cancellation
If you need to reschedule your session, please provide as much notice as possible.
The Studio will make reasonable efforts to accommodate one rescheduled session, subject to availability. Additional rescheduling may require a new retainer.
If the Client cancels a session, any refund will be handled according to the Studio’s stated retainer and cancellation policy.
If the Studio must cancel or reschedule due to illness, emergency, severe weather, equipment failure, or another circumstance outside its reasonable control, the Studio will make reasonable efforts to reschedule the session. If rescheduling is not possible, the Client will receive a refund of payments made for services that were not provided.
4. Arrival & Late Clients
Clients are asked to arrive on time and ready for their scheduled session.
Late arrival may reduce the amount of shooting time available. The Studio cannot guarantee that a session can be extended to make up for time lost due to the Client’s late arrival.
If the Client is significantly late or fails to attend the session, the Studio may treat the session as a cancellation.
5. Client Preparation & Cooperation
The Client is responsible for arriving prepared for the session, including clothing, hair, makeup, and any requested personal items or props unless otherwise agreed.
The Studio will provide reasonable direction and posing guidance during the session. The Client understands that the final appearance of the images may be affected by factors such as clothing, styling, weather, lighting, and cooperation during the session.
6. Children & Minors
A parent or legal guardian must provide consent for photography involving a minor.
The Client is responsible for supervising children during the session unless otherwise agreed.
7. Image Selection & Editing
The Studio retains creative discretion over the selection and editing of images.
Only images selected and delivered by the Studio will be considered final images. Unedited images, RAW files, outtakes, duplicates, or rejected images are not included unless specifically agreed in writing.
Editing style, color, cropping, and artistic choices are part of the Studio’s creative work and may not be altered or reproduced by the Client.
8. Delivery of Images
Final images will be delivered through [online gallery / digital download / other method] within approximately [X weeks] following the session.
Delivery times are estimates and may vary due to workload, illness, technical issues, or circumstances outside the Studio’s reasonable control.
The Client is responsible for downloading and backing up digital images after delivery. The Studio recommends maintaining multiple backups.
The Studio will make reasonable efforts to maintain a backup of delivered images for [X months], but does not guarantee permanent storage.
9. Copyright & Personal Use
Finksey Studios retains the copyright to all photographs created during the session.
Upon full payment, the Client receives a personal-use license to download, print, and share the delivered images for personal, non-commercial purposes.
The Client may not sell the images, use them for commercial purposes, submit them to advertising or promotional campaigns, or materially alter the images without the Studio’s written permission.
The Client may share images on personal social media accounts, provided the images are not materially altered and reasonable credit is given to Finksey Studios when practical.
10. Client Privacy & Marketing Use
Finksey Studios will not use the Client’s photographs for advertising, social media, website portfolios, publications, competitions, or other promotional purposes without the Client’s separate written permission.
Booking a photography session does not grant the Studio permission to use the Client’s likeness or photographs for marketing.
Any future request to use a Client’s images for promotional purposes will be made separately and will require the Client’s consent.
11. Photographer’s Artistic Style
By booking Finksey Studios, the Client acknowledges that they have reviewed the Studio’s portfolio and are familiar with its photographic and editing style.
The Studio will use its professional judgment and artistic discretion when creating and editing images.
Specific poses, backgrounds, lighting conditions, or photographs cannot be guaranteed unless expressly agreed upon in advance.
12. Image Loss or Equipment Failure
The Studio takes reasonable precautions to protect photographs and equipment. However, in the unlikely event that photographs are lost, corrupted, damaged, or otherwise become unavailable due to equipment failure, technical problems, theft, natural disaster, or other circumstances beyond the Studio’s reasonable control, the Studio’s liability will be limited to the amount paid by the Client for the affected photography services.
13. Personal Items & Property
The Client is responsible for personal belongings brought to the session. Finksey Studios is not responsible for lost, stolen, or damaged personal property except where caused by the Studio’s negligence or as otherwise required by law.
14. Model Release
No separate model release is granted to Finksey Studios for marketing or promotional use of the Client’s photographs unless the Client separately provides written consent.
15. Limitation of Liability
To the fullest extent permitted by applicable law, Finksey Studios’ liability arising from the photography services will be limited to the amount actually paid by the Client for the affected services.
Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or limited.
16. Force Majeure
The Studio will not be considered in breach of these terms for delays or failure to perform caused by circumstances beyond its reasonable control, including serious illness, natural disasters, severe weather, government restrictions, power outages, or other emergencies.
17. Agreement
These Terms & Conditions, together with any applicable booking agreement or invoice, constitute the agreement between Finksey Studios and the Client regarding the photography services.
By booking a session and/or making payment, the Client acknowledges that they have read, understood, and agreed to these Terms & Conditions.
